Terms of Service

1. Acceptance of Terms

By downloading, installing, or using Kahwin ("the App"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree, do not use the App. These Terms form a binding agreement between you and Opnix Digital Studio ("we", "us", or "our").

We may update these Terms from time to time. Continued use of the App after changes constitutes acceptance of the updated Terms.

2. Eligibility

You must be at least 13 years of age to use Kahwin. By using the App, you represent and warrant that you meet this requirement. If you are under 18, you represent that a parent or guardian has reviewed and agreed to these Terms on your behalf.

3. Your Account

You are responsible for maintaining the confidentiality of your account credentials. You agree to:

Provide accurate and complete information when creating your account
Keep your login credentials secure and not share them with others
Notify us immediately if you suspect unauthorised access to your account
Take responsibility for all activity that occurs under your account

We reserve the right to suspend or terminate accounts that violate these Terms.

4. Permitted Use

Kahwin is provided for personal, non-commercial wedding planning purposes. You agree not to:

Use the App for any unlawful purpose or in violation of any regulations
Attempt to reverse-engineer, decompile, or extract the source code of the App
Use automated tools, bots, or scrapers to access the App or its data
Upload or transmit any malicious code, spam, or harmful content
Attempt to gain unauthorised access to other users' data or our systems
Resell, sublicense, or commercially exploit the App without our written permission

5. Your Content

You retain ownership of all content you upload or create within the App ("Your Content"), including guest lists, budget data, photos, and notes. By using the App, you grant us a limited, non-exclusive licence to store and process Your Content solely for the purpose of providing the service to you.

You are solely responsible for Your Content and warrant that it does not infringe any third-party rights or violate any applicable laws.

6. Uploaded Content

When you upload photos, images, or other media to the App ("Uploaded Content"), you confirm that:

You own the Uploaded Content or have the necessary rights and permissions to use it
The Uploaded Content does not infringe the copyright, trademark, or other intellectual property rights of any third party
The Uploaded Content does not contain anything unlawful, offensive, or harmful

We reserve the right to remove any Uploaded Content that violates these Terms or that we are asked to remove by you or a rightful rights holder. We will not be liable for any Uploaded Content that you or other users submit.

7. Subscription & Billing

Kahwin offers both a free tier and a paid Premium subscription. By subscribing to Premium, you agree to the following:

Subscriptions are billed on the billing cycle you selected at the time of purchase (weekly, monthly, quarterly, bi-annually, or annually)
Payments are processed by Apple App Store or Google Play, subject to their respective terms
Subscriptions automatically renew unless cancelled at least 24 hours before the renewal date
You can manage and cancel your subscription through your App Store or Google Play account settings
We do not offer refunds for partial subscription periods, except where required by applicable law
We reserve the right to change subscription pricing with reasonable notice

8. Free Trial

We may offer a free trial period for Premium. At the end of the trial, your subscription will automatically convert to a paid subscription unless you cancel before the trial ends. You will be charged at the applicable subscription rate upon conversion.

9. Referral & Affiliate Program

We may offer a referral or affiliate program that rewards you for inviting new users to Kahwin. Participation is subject to the specific terms of the program as communicated in the App. We reserve the right to modify, suspend, or terminate the program at any time. Any suspected fraud or abuse of the referral system may result in account suspension.

10. Intellectual Property

All intellectual property in the App — including its design, graphics, trademarks, and content created by us — is owned by or licensed to Opnix Digital Studio. Nothing in these Terms grants you any right to use our intellectual property outside of the App.

11. Disclaimer of Warranties

The App is provided "as is" and "as available" without warranties of any kind, express or implied. We do not warrant that the App will be uninterrupted, error-free, or free of harmful components. We are not responsible for the accuracy or completeness of any information generated or displayed in the App.

12. Limitation of Liability

To the maximum extent permitted by applicable law, Opnix Digital Studio shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of or inability to use the App — including but not limited to loss of data, loss of revenue, or any wedding-related losses.

Our total liability to you for any claim arising out of these Terms shall not exceed the amount you paid us in the 12 months preceding the claim.

13. Indemnification

You agree to indemnify and hold harmless Opnix Digital Studio and its officers, employees, and agents from any claims, damages, or expenses (including legal fees) arising from your use of the App, Your Content, or your breach of these Terms.

14. Termination

You may stop using the App and delete your account at any time through the App settings. We reserve the right to suspend or terminate your access without notice if you violate these Terms or if we discontinue the App. Upon termination, your data will be deleted in accordance with our Privacy Policy.

15. Governing Law

These Terms are governed by and construed in accordance with the laws of Malaysia. Any disputes arising out of or in connection with these Terms shall be subject to the exclusive jurisdiction of the courts of Malaysia.
